These Terms of Service ("Terms") are an agreement between you and Bellyful.ai ("we," "us," or "our") covering your use of the Bellyful.ai mobile app, the website at bellyful.ai, and related services (together, the "Services").
Please read these Terms carefully. They include important information about your rights, limits on our liability, and how disputes are resolved.
1. Acceptance of These Terms
By creating an account, RSVPing to a Bellyful.ai event, or using the Services in any other way, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Who Can Use Bellyful.ai
You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent's or guardian's permission to use the Services.
You may use the Services only for lawful purposes and only in compliance with these Terms and any applicable laws.
3. Your Account
If you create an account, you are responsible for:
- Providing accurate, current information
- Keeping your sign-in credentials confidential
- All activity that happens under your account
- Promptly notifying us at support@bellyful.ai if you suspect unauthorized use
You may close your account at any time from the app under Settings.
4. Using the Services as a Guest
You do not need an account to RSVP to a Bellyful.ai event. If you RSVP as a guest, you agree to these Terms with respect to the RSVP interaction, including the one-time password (OTP) verification, any dietary information you provide, and any item you commit to bring.
5. Acceptable Use
You agree not to:
- Use the Services to send spam, scams, or unwanted marketing
- Impersonate another person or misrepresent your affiliation with anyone
- Submit content that is unlawful, threatening, harassing, discriminatory, sexually explicit, or otherwise objectionable
- Upload malware or interfere with the security of the Services
- Scrape, crawl, or copy data from the Services using automated means
- Reverse engineer, decompile, or attempt to derive source code, except as permitted by law
- Use the Services to collect personal data about other users in bulk
- Use the Services to violate any other person's rights or the law
We may suspend or terminate access for any violation.
6. User Content
"User Content" means anything you submit to the Services: event details, menus, guest lists, dietary notes, messages, feedback, and similar.
- You keep ownership of your User Content. We do not claim ownership of it.
- License to us. You grant Bellyful.ai a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and transmit your User Content, solely for the purpose of operating and improving the Services.
- Responsibility. You are responsible for the User Content you submit and for any consequences of sharing it. Hosts are responsible for the accuracy of guest information they enter on behalf of others, and for having an appropriate basis to share that information (for example, a reasonable expectation that the guest wants to be invited).
7. AI-Generated Menus
Bellyful.ai includes an AI-powered menu suggestion feature. The menus are generated automatically based on inputs such as the number of guests, dietary restrictions entered by hosts and guests, and cuisine preferences.
You acknowledge and agree that:
- AI-generated menus are suggestions only. They are not medical, nutritional, or dietary advice.
- The AI may make mistakes, miss allergens, misinterpret cultural or religious requirements, or produce suboptimal suggestions.
- You are responsible for reviewing every suggestion before acting on it.
- Bellyful.ai is not a substitute for professional medical, nutritional, or religious guidance.
8. Dietary Safety Disclaimer
Food allergies, religious dietary laws, and medical dietary needs can involve serious safety risks. Bellyful.ai helps hosts collect, organize, and plan around dietary information, but Bellyful.ai does not prepare food, source ingredients, or supervise cooking.
You, as the host, are solely responsible for:
- The accuracy of dietary information you enter or rely on
- Ingredient sourcing and label verification
- Avoiding cross-contamination during preparation and service
- Communicating directly with guests who have life-threatening allergies or strict religious requirements before they eat
Guests are responsible for confirming that any dish they consume is appropriate for their dietary needs. If you have a severe allergy or medical condition, always verify ingredients directly with the person who prepared the food.
Bellyful.ai makes no guarantee that any menu, item, or assignment is free of any specific allergen or meets any specific religious certification standard.
9. Communications, SMS, and Email
By using the Services, you consent to receive transactional communications from us, including:
- SMS: OTP verification codes, event invitations, RSVP reminders, and event cancellation or schedule changes, as described in our Privacy Policy. You can reply STOP to opt out of SMS at any time and HELP for help. Message and data rates may apply.
- Email: account-related messages such as OTP codes, RSVP confirmations, event reminders, security alerts, and policy updates.
We do not send marketing SMS. If we send marketing or newsletter emails in the future, they will include a clear unsubscribe link per CAN-SPAM.
10. Fees and Pricing
The Services are currently free to use for hosts and guests. We reserve the right to introduce paid features in the future. If we do, we will describe the fees clearly before you are charged. We will never convert your existing free usage into a paid subscription without your explicit consent.
11. Intellectual Property
The Bellyful.ai name, logo, app, website, content (other than User Content), and underlying technology are owned by Bellyful.ai or its licensors and are protected by copyright, trademark, and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services, subject to these Terms.
You may not use our trademarks without our prior written permission.
12. Third-Party Services
The Services use third-party providers such as Amazon Web Services, Mixpanel, and UXCam. We are not responsible for the availability, content, or practices of third-party services, except as described in our Privacy Policy.
13. Termination
You may stop using the Services and delete your account at any time.
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for Bellyful.ai, or for any other reason permitted by law. Sections 6 through 19 survive termination.
14. Disclaimers of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Bellyful.ai disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
We do not warrant that AI-generated menus are accurate, complete, safe, or suitable for any particular person, event, or dietary need.
15. Limitation of Liability
To the fullest extent permitted by law, Bellyful.ai and its officers, employees, and contractors will not be liable for:
- Indirect, incidental, consequential, special, exemplary, or punitive damages
- Loss of profits, data, goodwill, or business opportunities
- Damages related to food allergies, adverse reactions, illness, or injury resulting from the preparation, serving, or consumption of food (see Section 8)
In all cases, Bellyful.ai's total aggregate liability to you for any claim arising out of or related to the Services is limited to the greater of (a) US $100, or (b) the total fees you paid to Bellyful.ai in the 12 months before the event giving rise to the claim. Because the Services are currently free, this cap effectively equals US $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless Bellyful.ai and its officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your User Content
- Your use of the Services
- Your violation of these Terms or any law
- Your violation of any third party's rights, including guests you invite
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. For any dispute:
- Informal resolution first. Please email legal@bellyful.ai with a description of your concern. We will try to resolve it informally within 60 days.
- Courts. If we cannot resolve the dispute informally, any lawsuit must be filed in the state or federal courts located in California, and you consent to personal jurisdiction there.
- Optional arbitration. Either party may elect to resolve a dispute by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be held in California unless both parties agree otherwise. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property misuse.
Class actions are not permitted. Disputes must be brought individually.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you by email (for app users) or by a notice on bellyful.ai, and we will update the effective date above. Changes take effect 30 days after posting, or sooner if required by law. Your continued use after that time means you accept the updated Terms.
19. Miscellaneous
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Bellyful.ai regarding the Services.
- No waiver. Our failure to enforce any provision is not a waiver.
- Severability. If any provision is unenforceable, the rest of the Terms remain in effect.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- No agency. Nothing in these Terms creates a partnership, agency, or employment relationship.
